    Alleged Firearms and Affray Offences | Kangs Criminal Defence Solicitors

    Kangs Solicitors recently defended a client charged with the offences of Possession of an Imitation Firearm and Affray.

    Nazaqat Maqsoom of Kangs Solicitors comments on the events which resulted in the Prosecution eventually not proceeding and formal ‘Not Guilty’ pleas being entered against our client.

    The Circumstances | Kangs Firearms Offences Defence Solicitors

    Our client was originally charged with the offences of:

    • Possessing a firearm, with intent to cause fear of violence and
    • Possessing a prohibited firearm.

    Due to the serious nature of the allegations our client was remanded into custody. At the Plea & Trial Preparation Hearing the Prosecution accepted that the above charges could not be proved based on the evidence and therefore the Indictment was amended to the lesser charges of:

    • Possessing an imitation firearm , with intent to cause fear of violence
    • Affray

    Our client entered not guilty pleas to both charges, but he was retained in custody and the matter was adjourned for a Trial.

    How We Assisted Our Client | Kangs Criminal Trial Specialists

    The Prosecution case was based on:

    • CCTV Evidence,
    • evidence from a witness who allegedly purportedly identified our client,
    • evidence from firearms officers

    As part of the preparation of our client’s defence Kangs trial preparation team:

    • thoroughly scrutinised all the evidence served by the prosecution, including the CCTV Evidence,
    • took detailed instructions from our client
    • prepared and served a detailed Defence Case Statement
    • prepared and served detailed Disclosure Requests upon the Prosecution and vigorously pursued them for production of the required material which they failed to provide.
    • secured our client’s release from prison on bail

    Ultimately, despite our protestations that the evidence was flawed, the matter was listed for a Mention Hearing at which the Judge ordered that the Prosecution provide disclosure the same day, but which obligation was only partially satisfied.

    The Prosecution reviewed the matter decided to offer no evidence and formal ‘Not Guilty Verdicts’ were entered in favour of  our client who left the court room a free man, who was delighted with the outcome.
