Infringement Of Airspace | Kangs Aviation Law Solicitors

A microlight pilot has been fined for infringing Red Arrows air display at the Flying Legends Air Show in July 2017, when he flew directly into the display forcing the team to break off at high speed.

Steven Micklewright of Kangs Solicitors, who holds a full Private Pilot’s Licence, comments.

What Is An Airspace Infringement? | Kangs Aviation Law Advisors

An airspace infringement is the unauthorised entry of an aircraft into notified airspace. This includes controlled airspace, prohibited or restricted airspace, active danger areas, aerodrome traffic zones, radio mandatory zones or transponder mandatory zones.

Breaching the Air Navigation Order is a criminal offence.

Appearing at Luton Magistrates’ Court, the pilot pleaded guilty to infringing the temporary restricted airspace and was fined £1,250 costs plus £500 was also awarded to the Civil Aviation Authority.

Principal Airspace Regulator at the CAA Rob Gratton said:

“restricted airspace, in this case, was established for the safety of the public, the aircraft and the crews. This was an example of poor planning and execution of a flight by a pilot whose actions were resolved by the Red Arrow pilots who, at the time, were operating under high workload, carrying out high speed formation manoeuvres. We will continue to work with the wider aviation industry to reduce the number of airspace infringements that occur throughout the UK”.
