European Economic Area (EEA) | Family Permit | The 'Surinder Singh' Route

Regulation 9 of the Immigration (European Economic Area) Regulations 2016, enables British Citizens who have lived and exercised treaty rights in another EU country to return to the UK with their spouse, children, parents and grandparents. 

This process is known as the ‘Surinder Singh Route’.

This Regulation would treat such a British Citizen as an EU National upon return.

Who Can Apply?

Any person who lives in an EEA country with an eligible British family member can make an application under this process.

To be eligible as a British family member a person must be the applicant’s dependant:  

  • husband/wife or civil partner or
  • parent or grandparent (or their spouse or civil partner) or
  • child or grandchild (or their spouse or civil partner).

The issue of an EEA Family Permit will allow a person to enter the UK with the British Family member.

Who Is Eligible?

An applicant must have been living in an EU country for a minimum period of three months and one day prior to making the application and be able to prove:

  • that such home in another EEA country was the main residence or base
  • there was joint residence
  • integration such as proof of speaking the language, child birth, involvement in the local community
  • that the British national family member was working, self-employed, self -sufficient or studying in the relevant EEA country.

What Visa Is Available?

  • An initial visa of six months may be granted to the non EEA National.
  • Before their visa expires, an application from a family member of an EEA National, under (Article 10), will attract an EEA Family Permit for five years.

Thereafter, there may be eligibility to apply for Permanent Residence or Indefinite Leave to remain in the UK.
