Rights Of Appeals In The UK
In Country Appeals
An applicant who is inside the UK and whose Application to remain in the UK has been refused by the Home Office will receive a ‘Notice of Decision’ which sets out:
- the Home Office decision
- the reasons why the Application has been refused, and
- whether there exists a right to appeal the decision.
In some cases an appeal can be lodged from inside the UK whilst in others it will be necessary to leave the UK in order to do so.
In the latter instance the right may exist to pursue an application for a Judicial Review to the High Court.
Any appeal will be sent to the First Tier Tribunal within fourteen days after the date the refusal letter was issued by the Home Office.

- The Appeal Process imposes strict deadlines and procedures and any failure to comply may result in the right to appeal being lost.
- The Court fees for the First Tier Tribunal are:
1. Paper Hearing – £80.00
2. Oral Hearing before an Immigration Judge – £140.00
Once your Appeal has been lodged with the Asylum and Immigration Tribunal they will inform the Entry Clearance Manager, who will have the opportunity to review your Notice of Appeal together with supporting evidences.
Well drafted Grounds of Appeal may lead to the original decision being overturned which would avoid the need for any attendance before the Immigration Tribunal.
If the Entry Clearance Manager does not overturn the decision then the matter will continue to an Entry Clearance appeal which will be heard at the Asylum and Immigration and Asylum Chamber before an Independent Immigration Judge.
You will be notified in writing of date that your Appeal Hearing will take place.
In this instance we are able to fully prepare your Appeal bundles, which will be forwarded to the Asylum and Immigration Tribunal and the Home Office. We will also represent you at the Asylum & Immigration Tribunal on date of hearing.
