Settlement Applications Solicitor
An application to settle in the UK can be made by anyone who has:
- temporary permission to remain in the UK
- spent the appropriate period of lawful continuous residence in the UK.
An application can be made in any immigration category, or a combination of different immigration categories.
A Settlement application can be made before the current permission to remain expires, whilst the applicant is resident in the UK and can be made twenty eight days before the end of the appropriate ‘qualifying period’.
The qualifying period may vary depending upon an individual’s circumstances.
A successful applicant will be granted a UK visa known as ‘Indefinite Leave to Remain’ (ILR) thereby permitting the individual to remain in the UK without any time limits or restrictions.

In order to qualify for ILR there are varying requirements to be satisfied and we recommend that you consult our Immigration Team to discuss the same in order to ensure that they are all properly attended to.
With the rising cost of fees payable upon each application, it is imperative that experienced advice is sought before submitting any application to the Home Office for their consideration in order to reduce the risks of any applications being refused and fee payments being wasted.
All applications must be made on the correct very detailed forms with full supporting documentation, which may present individual technical difficulties.
Failure to submit a proper application could result in the issue of a Notice of Refusal leading to an illegal overstay.
