The Circumstances | Kangs Environmental Health Investigations Defence Solicitors

Environmental Health Officers, upon searching the kiosk in September 2021 discovered that:        

  • the kiosk floor and card payment machine were not clean;
  • fixtures and fittings inside the kiosk were unhygienic;
  • there were accumulations of fat and dirt on equipment;
  • the overall standard of the business which was selling food to the public was extremely poor.

At the Hearing before Scarborough Magistrates’ Court, the kiosk owner pleaded guilty to five food hygiene offences which resulted in the following penalties being imposed:

  • a fine of £784,   
  • costs amounting to £1,000,    
  • a surcharge of £74.              

Official comment:

Jonathan Bramley, an environment and regulation manager, said:

‘We take food hygiene very seriously and we will not hesitate to take action against any food business operator that fails to keep their premises clean and maintained in good condition.

Unfortunately, there was a history of poor non-compliance with food hygiene regulations by this food business operator and we had little choice but to take formal action against her.

We can only hope that the court action results in the necessary improvements being made.’
