Investigation into married couple alleged to have been involved in facilitating illegal immigration into the UK from a non-EU Country

Cagin Husnu of Kangs Solicitors represented a husband and wife, who owned a nail salon, who were being investigated by the Home Office for alleged offences of facilitation, following a ‘tip-off’ from an undisclosed source.

The offence of facilitation is contained within section 25 of the Immigration Act 1971 which states that a person shall be guilty if he:

a) does an act which facilitates the commission of a breach of immigration law by an individual who is not a citizen of the European Union;
b) knows or has reasonable cause for believing that the act facilitates the commission of a breach of immigration law by the individual, and
c) knows or has reasonable cause for believing that the individual is not a citizen of the European Union.
