If you are involved in a shareholder dispute, it is in both your interests and that of the company to resolve the matter swiftly and effectively. Our team has in-depth knowledge and extensive experienced in acting for both minority and majority shareholders in a wide range of disputes.

Shareholder disputes can be expensive and often in circumstances where a resolution cannot be achieved, have a detrimental effect on the company. Consequently, we at KANGS take the view that it is often more pragmatic and practical to try and resolve a dispute as commercially as practicable, rather than embarking immediately on litigation, which is both expensive and time-consuming.

Our team includes trained business mediators who can facilitate dialogue between parties or act on your behalf to achieve the resolution of ongoing disputes.

Our aim is to help you reach a resolution through Alternative Dispute Resolution (ADR) rather than immediately embarking on formal proceedings. What is a shareholder dispute?

A disagreement among shareholders or between shareholders, which may arise from a breach of any formal shareholder agreement, or from an implied agreement on “how things were done.”

How can I resolve a shareholder dispute?

There are two main ways of resolving a shareholder dispute, litigation or Alternative Dispute Resolution (ADR). ADR encompasses a range of methods such as mediation that parties may adopt to resolve a dispute. It is generally more cost effective than court-based litigation and disputes tend to be resolved much more quickly.

Litigation is an alternative method for resolving shareholder disputes. However, the litigation process can be time-consuming, costly, and with no guarantee as to the outcome. If the only recourse is litigation, our team of experienced lawyers will guide you through the litigation process and ensure that your position is robustly protected at all times.
