The Rights of EU Nationals in the UK | Immigration Solicitors

Following the BREXIT referendum, the future of EU nationals residing in the UK has become very uncertain and, whilst the government has stated that those already in the UK will be allowed to remain, no assurances have been given.

The government has stated that EU nationals will be able to remain in the UK "so long as" British citizens receive the "same treatment" in the EU.

Despite this uncertainty, EU nationals are still allowed to enter and live in the UK.

Immediate effects of the Brexit referendum | Kangs Immigration Lawyers

There has been a surge in the number of EU citizens applying to the Home Office to try and secure their right of residence in the UK given the uncertainties which they face.

A right of residence requires an applicant to be:

  • In employment,
  • Self employed,
  • Engaged in a course of recognised study or
  • Financially self sufficient.

The right of residence is beneficial in that it:

  1. enables the applicant to bring into the UK certain family members, relatives and partners
  2. provides entitlement to welfare benefits and
  3. carries the opportunity, after 5 years of continuous residence, to acquire permanent residence
