The term assault encompasses a wide range of criminal offences, from incidents involving minimal or no physical injury through to allegations involving serious injury and significant harm.

The seriousness of an allegation will depend on a range of factors, including:

  • the nature and extent of any alleged injuries,
  • whether there was an intention to cause harm,
  • the circumstances surrounding the incident,
  • the degree of culpability, including any evidence of planning or premeditation, and

Should I have a solicitor before answering police questions?

Yes. Regardless of whether you consider the allegation to be entirely unfounded, obtaining specialist legal advice before interview is one of the most important steps you can take.

Can assault allegations be withdrawn?

Whilst a complainant can withdraw their support for an allegation, this does not automatically bring an investigation or prosecution to an end. The decision whether to continue proceedings rests with the police and the Crown Prosecution Service (CPS).

Will my case go to court?

Not all allegations result in court proceedings. Some cases are discontinued during the investigation stage, whilst others are resolved before trial.
