An unregulated ‘Immigration Advisor’ has recently been sentenced for providing unqualified and unregulated advice.

In order to provide legitimate immigration advice a person must be appropriately qualified and regulated by an authoritative body, such as the Solicitors Regulation Authority or the Office of the Immigration Services Commissioner (‘OISC’).

The Circumstances | Kangs Immigration Advice Solicitors

The defendant in this particular matter was prosecuted by the OISC after they had been made aware of his unqualified and unregulated activities.

It was discovered that the defendant had been prosecuted for the exact same offence in 2014 and been sentenced by a court to twenty four weeks imprisonment.

The defendant was:

  • sentenced to twelve months imprisonment,
  • made subject to a Criminal Behaviour Order (prohibiting him from providing immigration advice/services for ten years years) and
  • handed a financial penalty of £64,700 to cover prosecution costs and compensation.
