    Success in Defending Former Premiership Footballer | Motoring Offences

    Kangs Solicitors represented the Aston Villa footballer Stiliyan Petrov at Birmingham Magistrates Court on the 23rd June 2016 for a trial in relation to matters under Section 172 Road Traffic Act 1988, a duty to give information as to the identity of a driver.

    Our client had been summoned to appear at Birmingham Magistrates Court as it was alleged that a motor vehicle registered to him had been driving in excess of the speed limit.

    It was alleged that Mr Petrov had failed to comply with two letters that had been sent out to him at his home address requiring him to provide confirmation of who was driving the vehicles registered in his name.

    The Prosecution case was that they had never received a response and relied upon evidence from the camera enforcement officer to confirm the speed, an employee from the Central Ticketing Office to confirm that a notice of intended prosecution had been sent to Mr Petrov together with two requests under Section 172 Road Traffic Act 1988 for confirmation of driver details.

    The Prosecution also sought to rely on exhibited correspondence that had been sent to Mr Petrov.

    How did we assist the client? | Motoring Law Solicitors

    Kangs Solicitors were able to advise our client fully in relation to the legislation and in particular Section 7 Interpretation Act whereby service is deemed to have been effective to him at his home address unless the contrary is proved.

    Detailed instructions were taken from our client in order to show that there had been previous instances whereby he had not received correspondence from various sources.

    Kangs Solicitors were able to obtain proof of this and place this before the Magistrates Courts.

    The Defendant was also able to show that he had taken steps to rectify the position of not being able to obtain his post once this became apparent to him.

    The Result | Driving Case Solicitors

    Our client faced the possibility of losing his driving licence if he was convicted of this offence.

    Having heard the case the Magistrates returned a not guilty verdict within five minutes and our client was naturally overwhelmed with the result obtained for him by Kangs Solicitors.

    After the verdict, Mr Petrov said:
