Dirty Takeaway Prosecuted For Breaches of Food Hygiene Regulations

The owner of an East-Midlands ‘takeaway’ business has been fined more than £2,500 for a number of food hygiene offences at his premises.

The Circumstances | Kangs Food Hygiene Solicitors

Inspectors from the local authority found a host of food hygiene breaches which included:

  • contamination between raw and cooked foods
  • failure to protect food from contamination
  • inadequate food management systems
  • no hot water supply to a hand-wash basin
  • staff not trained or supervised in food handling roles
  • dirty premises

The owner pleaded guilty to fourteen offences under the Food Safety and Hygiene (England) Regulations 2013 and was fined in excess of £2,500.

Councillor Paul Hillier said:

‘the Council has a duty to protect the public from such “cavalier” food operators and ensure the food they buy is safe and the premises that sell it do not expose them to harm…this prosecution and the sentence imposed by the Court should serve as a warning to other food business operators’

The Relevant Law | Kangs Food Safety Solicitors

The Food Safety and Hygiene (England) Regulations 2013 (‘the Regulations’) impose requirements on food business operators to:   

  • ensure that food is safe for human consumption; and
  • enforce food hygiene requirements

The Regulations apply to all food business operators and include all those who manufacture, prepare, handle, process, package, store, transport, sell distribute or supply food.

The main provisions of the Regulations include premises registration, food safety management systems and staff training in food hygiene.
