    Explosives Offences | Kangs Serious Crime Defence Solicitors

    Whilst crimes involving the use of explosives are generally associated with terrorism there exists a number of other crimes also involving the use of explosives.

    Legislation | Kangs Explosives Offences Advisory Solicitors

    The Explosives Act 1883 

    By virtue of this Act:

    • it is illegal to use, or conspire or intend to use, any substance to cause an explosion which is likely to endanger life or to cause serious injury to property, whether or not an explosion takes place [an example of this may well be an attack upon cash machine involving explosives]
    • conviction could potentially result in a lifetime prison sentence
    • possession of explosives in suspicious circumstances may result in imprisonment for two years
    • anyone assisting the commission of such crime may be as equally liable as the person who actually uses the explosives.

    The Customs and Excise Management Act 1979  

    This Act provides for the prosecution of anyone evading the prohibition on the import of explosives and, provided that it is not terrorist related, could result in a maximum prison sentence of seven years.

    Offences In Regard To Fireworks

    The storage, transport, preparation and ignition of fireworks are heavily regulated with breaches potentially involving penalties ranging from a fine through to a prosecution for gross negligence manslaughter, which could lead to a life sentence, where  the person with responsibility is in breach of statutory guidelines/regulations and there exists a causal link between the breach and the death.

    • Offences under the Explosive Substances Act 1883.
    • Offences under the Customs and Excise Management Act 1979.
    • In the discreet circumstances of the case, our client may, potentially, have also been charged with attempted murder.
