Delighted Client Acquitted of Alleged Sexual Assault

KANGS has successfully defended our client, a twenty-five year old man, who was facing charges of sexual assault under section 3 of the Sexual Offences Act 2003. From the outset, our client vehemently maintained his innocence and denied any wrongdoing.

The Allegations

The police were contacted by two complainants who reported that on separate occasions they had both been sexually assaulted by the defendant. The allegations amounted to sexual touching both under and above clothing of areas of the body. As the police investigated, and witnesses were spoken to, a further complaint was made by a third complainant that a similar sexual assault had taken place a few years earlier.

The defendant was initially arrested and charged and subsequently sought our assistance.

How We Prepared

By way of preparation for the Trial, the team at KANGS attended our client, taking detailed instructions and advising upon the appropriate manner in which to proceed. We critically analysed all of the evidence served by the Prosecution, including the unused material, and discussed it in great detail with our client.

We prepared our client’s extensive detailed Proof of Evidence and comments on the Prosecution evidence. Throughout the process, we continually advised our client in detail upon their position as the matter progressed and represented him at all Court Hearings.

Additionally, we attended upon character witnesses and prepared their supportive Statements. We also prepared and served a detailed Defence Case Statement, which contained numerous requests for detailed disclosure from the Prosecution of material essential to the preparation of our client’s defence.

Furthermore, we identified and instructed appropriately experienced counsel of the highest calibre. Finally, we attended all requisite preparatory conferences with both our client and counsel.

Material Disclosure of Documents

To assist in the conduct of a fair Trial a defendant is entitled to be served with all known material including that which could assist in his defence. The Prosecution is obliged to serve such material even though it may reveal any weakness in its case against the defendant.

The Prosecution must pursue all reasonable lines of enquiry including all matters which could point towards innocence as well as guilt.

Prosecution Disclose Crucial Evidence

Despite the relentless pressure we exerted upon the Prosecution for disclosure of particular material which we considered essential, our requests were not complied with. Accordingly, we insisted that the matter be listed for a Court Hearing to enable the Court to resolve the issue.

Under this pressure, the Prosecution responded by, among other things, returning our client’s mobile phone to him. This was absolutely essential to our client’s case as, whilst the police had stated that it did not contain any important evidential material, this was found to be false as it contained evidence which seriously undermined the Prosecution’s case.

Having reviewed its position, the Prosecution withdrew a number of its charges and not guilty verdicts for those counts were formally entered at court in April 2024. However, the Prosecution continued to proceed with the remaining sole count of sexual assault.

The Successful Outcome

The Trial of the remaining count commenced in March 2025 and, prior to the Jury being sworn in, a legal argument took place concerning the admissibility of certain evidence which resulted in the Judge ruling that such evidence could not be adduced to the Jury.

Eventually, the Trial commenced but was stopped by the Judge as the result of the unsatisfactory nature of the Prosecution evidence. She directed the Jury to return a ‘Not guilty verdict’ which resulted in our client immediately being discharged and allowed to walk from court freed of the stress and worry of fighting these accusations which had hampered his life for so long.

Naturally, our client was delighted with this highly successful outcome his mother stated:
