Application to Include Client on DBS Barred List Defeated

As the result of KANGS involvement, the Disclosure and Barring Service (DBS) has agreed that our client should not be included on the list which would have prevented continued involvement in his role as a Health Care Support Worker within the NHS at various hospitals.

Background
Our client, an NHS Health Care Support Worker, faced a series of allegations relating to their employment, specifically, of working overlapping shifts for two employers, allegedly allowing another individual to work shifts in their place, sharing confidential information, and receiving potentially fraudulent payments. Our client categorically denied any involvement or knowledge of these actions and provided a detailed response to each of these accusations.
How We Assisted Our Client | Minded to Bar Letter
Our client instructed KANGS following his receipt of a 'Minded to Bar' letter from the DBS, which suggested the possibility of him being barred from engaging in regulated activities involving children and/or adults.
Given the time limits involved, the team at KANGS immediately:
- thoroughly examined and considered the documents served by the DBS,
- obtained detailed instructions from our client, advised him upon his position and the steps to be taken on his behalf to seek to defeat the application,
- collated and examined all requisite documents to support our client’s opposition to the Minded to Bar letter,
- prepared a comprehensive document containing details of our client's personal background, his reasons for denying the allegations made against him and setting out his version of events.
The document also emphasised:
- the consequences of being included on the Barred List, which would lead to his inability to provide for his children,
- his assertions that he had not engaged in deceptive behaviours, had consistently prioritised patient safety, and had taken proactive measures to prevent further incidents of the nature complained of.
Successful Outcome
Once it had considered all of the material meticulously prepared and presented by the team at KANGS, the DBS decided not to include our client on any Barring List.
Naturally, our client was absolutely thrilled at this outcome and expressed immense gratitude for the fact that he can now continue with his career and domestic and personal life freed of the complications which he potentially faced.
