  • Legal definition.

The offence, covered by common law is committed when a person who is of ‘sound mind’ unlawfully kills another person with intent to kill or to cause really serious harm.   

  • Procedure at the Investigation stage.
  1. A person arrested on suspicion of murder will be taken to the Police Station and detained for the purpose of being interviewed.
  2. This is a most crucial stage in the potential defence of a murder allegation and it is essential that very experienced legal support is obtained.
  3. It is at this stage that our team will obtain disclosure from the police Investigation Team to ascertain and evaluate the allegations to ensure our client’s interests at the Police Station are protected.     
  • Initial Procedure at the Court Stage.
  1. The first appearance will be before the Magistrates’ Court.
  2. An application for bail cannot be made at the Magistrates’ Court if bail has been refused at the Police Station
  3. Shortly after the appearance before the Magistrates Court the first hearing before the Crown Court will take place.  Ahead of this, our team will advise upon the prospects of securing bail. The Judge has the ultimate decision on whether bail is to be granted. 
  • Preparing for Trial.
  1. The Kangs team will take detailed instructions and advise as the case progresses.
  2. All evidence served by the Prosecution will be scrutinised and analysed in depth.
  3. If any Defence Expert is required to either vigorously challenge the Prosecution evidence or support our client’s defence, the most appropriate expert(s) will be carefully identified and instructed.

R v G

Acquitted of murder and manslaughter. We represented one of three accused of the murder of a friend with whom they had been drinking earlier in the day. Our client was alleged to have been involved in a vicious group attack upon the victim which resulted in his death. The Prosecution heavily relied on the forensic evidence relating to the blood distribution on the clothing belonging to our client. We instructed a defence expert to re-examine this evidence. The jury found our client was found not guilty of all charges

R v M

Represented the husband of the couple accused of murdering their French nanny and then attempting to dispose of her remains by barbecuing them in the garden of their property. The wife believed the nanny was scheming with her ex-boyfriend. As a result of this misconceived belief, the nanny was punished which eventually lead to her death.

R V G

Acquitted of Conspiracy to Murder. Our client was one of three defendants charged in the case which was brought by the Murder Investigation Team based in the West Midlands. The Prosecution alleged our client and others had recruited another to enter a local Public House in Birmingham to carry out an assassination / revenge shooting with a firearm after the client himself was a victim of a ferocious machete and knife attack earlier the same morning. The Prosecution sought to rely upon hearsay and expert evidence which was robustly challenged during the proceedings and subsequently excluded. At the close of the Prosecution case, a submission of no case to answer was made and which was successful. The Jury was directed to enter a Not Guilty verdict.

R v B

Acquitted of three Counts of Murder. During the lengthy trial a wide variety of expert evidence was adduced by the Kangs team, including cell site evidence and CCTV evidence, to achieve a very favourable outcome for our client.
