Unlawful Immigration | Kangs Organised Crime Defence Solicitors

Kangs Organised & Serious Crime Team has been instructed to represent a client alleged to be involved in a large conspiracy involving facilitating immigration and a number of other immigration offences conducted over an eight year period.

The case is being prosecuted by the International Justice and Organised Crime Division Department of the Crown Prosecution Service.

What Is Facilitating Immigration? | Kangs Criminal Defence Solicitors

The offence of Assisting Unlawful Immigration is governed by Section 25 of the Immigration Act 1971 and under section 25 (1) a person commits the offence if he/she:

  1. Does an act which facilitates the commission of a breach of immigration law by an individual who is not a citizen of the European Union;
  2. Knows or has reasonable cause for believing that the act facilitates the commission of a breach of immigration law by the individual; and
  3. Knows or has reasonable cause for believing that the individual is not a citizen of the European Union.

The offence carries a maximum sentence of fourteen years imprisonment followed by Confiscation Proceedings under the Proceeds of Crimes Act 2002.
