What is a Historic Sexual Offence?

An Historic Sexual Offence is simply an alleged offence where the allegations concerning the incident are made a long time after it occurred.

Generally, the incident complained of will fall within the current law at that time.

The Relevant Law | Sexual Offences Act 1956

Most cases are prosecuted either under the Sexual Offences Act 1956 or, for offences that occurred after 1st May 2004, the Sexual Offences Act 2003.

The punishment that a Court can impose differs under the two Acts.

Allegations of Historic Sexual Offences are very difficult to defend, simply by virtue of the age of any evidence that has survived, the normal lack of any evidence of a reliable nature and the vagaries of human memory.

Some individuals may remember events clearly and in great detail whereas others may have little or no recollection.
