    New Speeding Rules | Kangs Motoring Offence Solicitors

    Amandeep Murria of Kangs Solicitors outlines the new speeding rules which came into force on the 24th April 2017.

    Level of Fines | Kangs Motoring Advisory Solicitors

    • Anyone exceeding the speed limit will now face a higher fine.
    • The increase can amount to as much as 175 % of weekly income together with a driving licence endorsment of a minimum number of three penalty points.
    • higher level of fines will be imposed on those drivers, who, for example, are caught doing 41 mph in a 20 mph zone, 51 mph in a 30 mph zone or 66 mph in a 40 mph zone.
    • drivers caught speeding at more than 101 mph when the speed limit is 70 mph could also be disqualified for up to 56 days.

    Categorisation of Fines | Kangs Solicitors Motoring Team

    The fines imposed by the Court are now determined in the following categories:

    • Band A 50 % of weekly income
    • Band B 100 % of weekly income
    • Band C 150 % of weekly income

    The Court will not exceed the maximum fines allowed in law.

    The maximum fine for speeding is £1000, unless the speeding offence takes place on the motorway, where the maximum fine is £2500.

    Steps 1 and 2 – Determining the offence seriousness

    The starting point applies to all offenders irrespective of plea or previous convictions.

    Where an offender is driving grossly in excess of the speed limit the court should consider a disqualification in excess of 56 days.

    The court ought to then consider a further adjustment for any aggravating or mitigating factors. Consideration of the relevant factors should result in an upward or downward adjustment before the sentence is imposed.
