Assault Charges Dismissed | How KANGS Defended a Client Against ABH Allegations

KANGS has successfully defended a client who had been charged with a single count of assault occasioning actual bodily harm upon his former wife.

Helen Holder of KANGS outlines the details of the case and the successful outcome.

The Circumstances

It was alleged that following an earlier argument, the former wife went downstairs and was sitting on the sofa, when our client approached her in a manner which caused her to believe that he was going to assault her.

In anticipation, she defensively raised a leg and in the resultant scuffle, she claims that she fell to the floor causing her to bang her head. She then alleges our client bent over and physically assaulted her, causing significant physical injuries.

The police were called and our client was arrested.

Our client completely denied any guilt and the alleged sequence of events, maintaining that his former wife was the aggressor and he merely reacted in self-defence.

How We Assisted Our Client

In preparation for the Trial, the team at KANGS attended our client taking detailed instructions, advising upon his position and the appropriate course of action to adopt in order to establish his innocence.

Additionally, we:

  • examined all the evidence served by the Prosecution and the unused material,
  • identified and instructed appropriately experienced Kings Counsel to represent our client at his Trial
  • obtained Statements from character witnesses in support of our client’s position,
  • liaised with all other parties including our client’s family law solicitors,
  • prepared our client for the trial including attending conferences with both our client and Kings Counsel.

The Trial

During the course of the Trial, which involved both parties giving their evidence in the normal fashion, our client’s former wife, under intense cross-examination by our client’s counsel, accepted that she may have held him in a way that caused immense pain, resulting in him striking her.

The Successful Outcome

Following their detailed consideration of all of the evidence presented to the Court, the Magistrates concluded that the prosecution failed to support the allegations which had been made and pronounced a verdict of ‘Not Guilty.’

Naturally, our client was elated with this result achieved by the team at KANGS. This outcome means his good character remains unblemished and he can move forward with his life, freed of the stress and worry which had burdened him for a long time.
