Not Guilty Verdicts for Client Facing Serious Rape Allegations

This trial commenced before Birmingham Crown Court following an investigation by the Public Protection Unit of West Midlands Police.

The client had entered into an arranged marriage, which quickly turned sour when his new bride and the complainant in this case changed her mind about the arrangement.  In an attempt to break the marriage, the complainant firstly reported the client to the authorities in an attempt to have him deported from the Country.  When this failed, she fabricated two separate allegations of rape.

The Defence were aware that there was crucial evidence held on the complainant’s mobile telephone seized by Police. After 12 months of working closely with the client and taking his detailed instructions as well as undertaking a protracted disclosure exercise to obtain the vital mobile phone evidence, the Prosecution offered no evidence against the client on day 3 of the trial.

Following, cross examination of the complainant and another relevant Prosecution witness it was clear that the allegations made were baseless and fabricated.  Upon direction of the Judge the jury returned not guilty verdicts in respect of both allegations of rape.

This matter had caused immense distress to the client, who was absolutely delighted when the Prosecution took the decision to offer no further evidence.
